We are aware that the security of your private information from the use of our website and mobile app (collectively, “the Platforms”) is an important concern. We take the protection of your personal information very seriously. Therefore we would like you to know what data we maintain and what data we discard. With this Privacy Statement, we would like to inform you about our privacy measures. This Privacy Statement describes how we treat personal information on the Platforms where this Privacy Statement is referenced or found. This Privacy Statement does not apply to other websites or platforms that have a different Privacy Statement, including www.lanxess.com. Personal information is sometimes also referred to as personal data, personally identifiable information or other like terms to mean any information that directly or indirectly identifies you or is reasonably capable of being associated with you. Personal information does not include de-identified or aggregated information that does not identify you.

We also describe in this Privacy Policy our handling of “sensitive” personal information or data, which are subject to additional protections under applicable data privacy laws.
LANXESS’ Platforms are intended for business-to-business transactions only, and we do not knowingly collect the personal information of individual consumers. By using our Platforms, signing up for our newsletter, or otherwise providing any information to LANXESS, you are acknowledging that you are a representative or agent of a business and not an individual consumer. You are also consenting to the collection, use, and disclosure of your information in accordance with this Privacy Statement.

Collection of Platform Activity Data

You are not required to provide personal information as a condition of using our Platforms, except as may be necessary to provide you a product or service at your request. When you use our Platforms, we store data for various administrative purposes. This data may include the name of your Internet service provider, the website that you used to link to our website or mobile app, the websites that you visit from our website or mobile app, your location, and your IP Address. This data could possibly lead to your identification, but we do not use it to do so. We do use the data from time to time for statistical purposes, but maintain the anonymity of each individual user so that the person cannot be identified. In cases when personal information is provided to others to provide you products or services you have requested, or for other purposes you have authorized, we rely on technical and organizational means to assure that applicable data privacy regulations are followed.

Collection and Processing of Personal Information

We collect personal information when you provide it to us, through registration, through our mobile app, completion of forms or emails, as part of an order for products or services, inquiries or requests about materials being ordered and similar situations in which you have chosen to provide the information to us. We collect personal information when you use the mobile app and contact us via the mobile app with questions regarding our products or services. Examples include your name, telephone number, email address, mailing address, IP Address, device ID, device type, user login information, and other information you may provide in the contact form. We collect business-to-business (“B2B”) data, which is personal information related to our business-to-business and vendor relationships, including business contact information provided to us to consummate the relationship and carry out business functions. Examples include your name, telephone number, email address, and mailing address.

We also collect certain personal information that is considered sensitive personal information or data. This includes precise geolocation.

Some of this data may be stored or processed at computers located in jurisdictions other than the jurisdiction in which you live and whose privacy or data protection laws may differ. We store personal information for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

We may also use push notifications on our mobile app. For example, we will send you push notifications about animal disease outbreaks related to recommended products.

Purposes of Use

The data we collect will be used for the purpose of supplying you with the requested products or services, to carry out B2B functions, to respond to your comments and questions and provide customer service, and as may otherwise be permitted by law. On certain Platforms, where you submit personal information, you may be asked to indicate your preferences as to whether or not you wish to receive information and/or promotional materials about our company and its products or services or about third parties with whom we have strategic business relationships and their products and services. We will respect any such preferences as indicated and you will have the ability to change such preference according to the "Choices" section below.

Choices

You have the right to review and amend any personal information stored in our system if you believe it may be out of date or incorrect. Just send an email to us by using the contact information identified in the “Contact Us” section below or the link in the Imprint for this website.

You have the right at any time to opt out of receiving from our company information and/or promotional materials. Again, just send an email to us by using the contact information identified in the “Contact Us” section below or the link in the Imprint for this website, or follow the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about our ongoing business relations.

You can control tools on your mobile devices. For example, you can turn off the GPS locator or push notifications on your phone. To modify the push notifications you get from our app, you can alter your preferences in your profile.

Use of Cookies

In some websites, so-called Cookies are used in order for us to improve the efficiency of your individual use of the website. Cookies are identifiers that our web-server could send to your computer in order to identify the computer being used for the duration of the session. Most browsers are set up to accept these Cookies automatically. In addition, you can deactivate the storing of cookies or adjust your browser to inform you before the Cookie is stored on your computer.

Our Do Not Track Policy: Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals. If you block cookies, certain features on our website may not work. If you block or reject cookies, not all of the tracking described here will stop.

Security

Where indicated, we use the Secure Socket Layer protocol (SSL protocol for short) to help ensure the secure transmission of your details to the server by encrypting customers’ details transmitted on the Internet.

Children

The Platforms are not intended for use by children under the age of 18, and we do not knowingly collect information directly from children under the age of 18. If we discover that we have received information directly from a child under the age of 18, we will delete that information. If you are a parent or legal guardian and believe we have collected information directly from your child, you may request that such information be deleted by using the contact information identified in the “Contact Us” section below or the Imprint for this website. 

California Privacy Rights

The California Privacy Rights Act ("CPRA") provides consumers who are California residents with certain rights with respect to their personal information. This section explains those rights. If you are a Platform visitor who is a California consumer and would like to exercise any of those rights, please see information listed below.

We have not shared your personal information with third parties for cross-context behavioral advertising.

Our prior 12-month personal information handling practices are consistent with our current personal information handling practices described in this Privacy Statement.

SELLING OR SHARING OF PERSONAL INFORMATION
LANXESS does not sell your personal information or share your personal information for cross-context behavioral advertising, and has not done so in the prior 12 months. LANXESS does not knowingly sell, share, use for cross-context behavioral advertising, or disclose the personal information of children under the age of 16, and has not done so in the prior 12 months.

SENSITIVE PERSONAL INFORMATION
Under the CPRA, certain types of personal information are considered “sensitive” personal information or data and require additional data privacy rights and obligations. LANXESS collects precise geolocation data, which may be considered sensitive personal information or data. We only collect this sensitive personal information to perform services on behalf of our business (“Permitted Uses”). Because LANXESS uses this sensitive personal information for Permitted Uses, there is no need for it to provide a Limit Use and Disclosure of Sensitive Personal Information right under the CPRA.

YOUR RIGHTS
The CPRA affords consumers residing in California the following rights with respect to their personal information, subject to certain exceptions. If you are a California consumer, you may have the right to:

  1. Request that LANXESS provide you the personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you.

    Only you or an authorized agent may make a request to know and access your personal information. You may have the right to make a free request twice during any twelve-month period.
  2. Request we delete certain personal information we collected from you. You may have the right to request that we delete your personal information, subject to certain exceptions. After we receive and validate your request, we will delete your personal information, unless an exception under the CPRA applies. Please be aware that, once deleted, your data, including your account and activities, cannot be restored.
  3. Request we correct inaccurate personal information that we maintain about you.
  4. Request that we stop selling your personal information or sharing your personal information for cross-context behavioral advertising. You may have a right to opt-out of sale of your personal information or sharing of your personal information for cross-context behavioral advertising. Note, however, LANXESS does not sell your personal information or share your personal information for cross-context behavioral advertising. As such, we do not offer this right.   5. Request to receive the information under right (1) in a format, to the extent technically feasible, that is portable, usable, and allows you to transmit the personal information to a person without impediment.
  6. Request related to “sensitive” personal information or data. The CPRA provides additional protection for sensitive personal information. Please see “Sensitive Personal Information” above for more information.
  7. Request related to automated decision-making and profiling. Note, however, LANXESS does not engage in any processing of your personal information for profiling in furtherance of decisions about you that produce legal or similarly significant effects. As such, we do not offer this right.
  8. Be free from unlawful discrimination for exercising your rights under the CPRA. We will not discriminate or retaliate against you for exercising any of your rights under the CPRA.

VERIFYING YOUR REQUEST
For your safety and the safety of your information, we cannot fulfill a request to provide, correct, or delete personal information if we cannot verify your identity or authority to make the request. We need to confirm the personal information relates to you or the individual for whom you are a lawful agent.

To verify your identity, we will ask that you provide the following information when you submit your request:

  • First Name
  • Last Name
  • Email Address
  • Mobile Phone Number
  • Address
  • City
  • State
  • Zip Code.

We may require additional verification information from you, including before deleting or disclosing particularly sensitive information. We will only use the verification information you provide for the purpose of verifying your identity or authority to make the request.

We will respond to your request within forty-five (45) calendar days. However, in certain circumstances, we may require additional time to process your request, as permitted by applicable law. We will advise you within forty-five (45) calendar days after receiving your request if such an extension is necessary and why it is needed.

Submitting a request does not require you to create an account with us. We do not charge you a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee (only if permitted under the law), we will tell you why we made that decision and provide you with a cost estimate before completing your request.

In some instances, we may not be able to honor your request. For example, we will not honor your request if we cannot verify your identity, if we cannot verify that you have the authority to make a request on behalf of another individual or if an exception applies. We will advise you in our response if we are not able to honor your request.

AUTHORIZED AGENTS
You may have the option to designate an authorized agent to submit a privacy rights request on your behalf. If we receive your request from an authorized agent, we may ask for evidence that you have provided such agent with a power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf.
